Terms & Conditions

1. The London Eye 'Share the Wow' campaign will run on digital out-of-home (OOH) screens on the London Underground from 3rd to 16th April, 2023. Participation in the campaign will involve submitting a photograph and relevant personal data via the London Eye website; if selected, your photograph, name and city of origin will be displayed as part of the campaign creative and you will be notified by means of an email notification. Please see details below regarding terms and conditions for participation. No payment is offered for participation in this campaign.
2. Participation in the campaign is open to anyone aged 18+ except employees (and their immediate families) of Merlin.
3. Please see our Cookie Policy and our Privacy Policy which sets out the terms on which we process any personal data we collect from you. By using our website and filling in the entry form you acknowledge that the processing is necessary in order to fulfil our obligations to you in respect of this campaign and to enable you to submit your photograph. You agree to Merlin Attractions Operations Limited (Merlin) transferring your personal data to other members of the Merlin Group and to our third-party vendors for the purpose of facilitating the campaign. You warrant that all personal data provided by you for the purpose of the campaign is accurate.

5. By uploading your photograph you agree to:
   a) assigns to Merlin your intellectual property rights in the entry with full title guarantee and shall execute any such documents and perform such acts as may be required for the purpose of giving full effect to such assignation; 
   b) waive all moral rights to the photograph, including all such rights to which you may now or at any time in the future be entitled to under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world; and
   c) agrees to grant Merlin a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual rights and moral rights in the photograph which you are unable to assign, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entry and any accompanying materials for such purposes. 
6. You confirm and warrant that:
   a) Photograph is an original work by you and does not contain any third party material, is not defamatory, and does not infringe third-party rights;
   b) there is no conflicting agreements in place that restrict usage of the photograph
   c) you have consent from all individuals shown in any photograph submitted to use such photograph for the purposes of the entry and any such individuals have waived all rights they may have in relation to such use;
   d) if the photograph shows or contains information about a person under 18, he/she has obtained parental or guardian consent to the submission of the photograph for the purposes of the entry
   e) you shall provide any evidence of any required consents at Merlin’s request, or risk being disqualified from the competition.
7. These terms and conditions are governed by relevant UK law and you and we agree to only bring legal actions about these terms and conditions in a UK court. We will try to solve any disagreements quickly and efficiently.  If you are not happy with the way we deal with any disagreement you and we may agree to refer the matter to arbitration but you and we are not restricted from bringing court proceedings.
8. By uploading your photograph for our campaign you agree to be unconditionally bound by these terms and conditions.
